Who this guide is for

Resident Indian individuals buying off-plan in Dubai for investment or a future home. NRIs living outside India follow different rules and are not limited by LRS in the same way.

How Indians pay for Dubai off-plan, step by step

1. Pick the unit and the plan. Ovation shortlists DLD-permitted projects and sends the live payment schedule.

2. Map instalments to your LRS limit. USD 250,000 per person per financial year. A 60/40 plan, for example, can spread payments across two or more financial years.

3. Co-owners remit separately. Where spouses or family members co-own, each resident remits within their own LRS limit for their share. Confirm clubbing rules for capital transactions with your bank.

4. Wire from your own funds. Your authorised dealer bank completes Form A2 and the LRS declaration and collects TCS.

5. Pay only the escrow account named in the SPA. Under Dubai Law No. 8 of 2007, instalments go to the regulated project escrow, never to a private account.

6. Register Oqood. The initial sale is registered with Dubai Land Department within 90 days of the SPA.

7. Disclose in your ITR. Report the property in Schedule FA every year.

TCS: plan the cash-flow gap

No TCS applies on the first ₹10 lakh remitted in a financial year. Above that, 20% is collected at the time of the wire. It is an advance tax, adjusted against your income-tax liability when you file, with any excess refunded. Keep the Form 27D certificate your bank issues. Budget the TCS on top of each instalment.

What is not permitted

  • Credit and debit cards cannot be used to pay for property abroad.
  • Loans taken in India cannot fund the remittance; LRS requires your own funds.
  • Cash in any amount.
  • Agricultural land, farmhouses and plantation property abroad are excluded.

Post-handover and mortgage plans: speak to your bank first

Deferred instalments after possession, or finance from a Dubai lender, can be treated as a credit arrangement under Indian rules. Before choosing a post-handover plan or a mortgage, ask your authorised dealer bank and tax adviser how it sits under LRS. Construction-linked plans paid before handover avoid that question.

Rental income and sale proceeds

Rent from a Dubai property is part of your global income as an Indian resident and is reported in your ITR. If you sell, the rules expect proceeds to be repatriated or reinvested within the permitted timelines. Ovation works with your CA on the paperwork trail: SPA, escrow receipts, Oqood and title.

Can Indian buyers use a post-handover payment plan?
