Dubai Commercial vs Residential Property for Indian Buyers
Commercial property is not automatically the higher-return choice. Compare it with residential on cash collected after service charges and vacancy, VAT treatment, tenant risk, resale demand and India remittance rules. This guide gives Indian buyers the calculation and evidence checklist.

The short answer
Choose commercial only when the unit, lease evidence and occupier demand justify its extra vacancy and resale risk. Residential usually offers a broader tenant and buyer pool, but a good apartment can still underperform after service charges and empty periods. Compare both on the same net-income basis; never compare an advertised commercial gross yield with an apartment’s net yield.
CBRE’s Q3 2026 review describes approximately 95% office occupancy in Dubai, alongside a residential market normalising as supply rises. That is market-level context, not a forecast for a particular tower, unit or lease. A high citywide occupancy rate does not tell you the empty period between your tenants.
Commercial vs residential: the comparison that matters
| Question | Commercial off-plan | Residential off-plan |
|---|---|---|
| What produces income? | A business occupier, its trade, permitted use and lease | Household demand for the unit, building and location |
| Sale VAT | Generally 5% on commercial supplies, including developer sales and leases | First residential supply within three years of completion is zero-rated; subsequent residential supplies are generally exempt |
| Recurring ownership cost | RERA-approved service charges where applicable; confirm chargeable area, cooling, reserve and sinking-fund items | Same evidence standard: check the project, usage, budget year and chargeable area |
| Rent evidence | Obtain actual comparable signed leases and incentives; do not rely on asking rents | Obtain signed comparable tenancy contracts; the official rental index is residential, not commercial |
| Vacancy exposure | Reletting can require fit-out works, approvals and incentives; one departing tenant can take income to zero | Often a wider occupier pool, but vacancy, renewal and building competition still apply |
| Lease diligence | Permitted use, licence needs, fit-out, reinstatement, rent-free periods, break rights and who pays service charges | Lease term, renewal, cheques, maintenance split and building restrictions |
| Exit pool | Investors and owner-occupiers needing that size, specification and permitted use | Investors and homebuyers; generally broader, but not assured liquidity |
| Foreign ownership | Available only in areas and interests designated for foreign ownership; verify the unit’s title | Same rule; a developer brochure does not replace the ownership check |
| Off-plan protection | DLD project registration, escrow and interim registration apply to off-plan real estate disposals | The same core framework; no commercial exemption is stated in DLD guidance |
This table describes the framework, not an opinion on a named project. The SPA, title documentation, approved plans and lease decide the outcome.
Net yield: use one formula for both
Net rental yield = (annual contracted rent − vacancy and rent-free allowance − landlord-paid service charges − other annual owner costs) ÷ total acquisition cash cost × 100.
Do not count tenant-paid outgoings as landlord savings until the signed lease says so. For an off-plan purchase, use the instalment schedule for cash-flow planning and the full acquisition cost for a like-for-like yield comparison. This calculation excludes finance, tax, currency movement, capital appreciation and selling costs unless you add them deliberately.
Hypothetical AED 2,000,000 unit — not a market quote or forecast
| Input | Assumption | Annual AED |
|---|---|---|
| --- | ---: | ---: |
| Contracted rent | Illustrative only | 140,000 |
| Vacancy and rent-free allowance | 10% of contracted rent | −14,000 |
| Service charges | 2,000 sq. ft. × AED 18 | −36,000 |
| Other owner costs | Management, repairs, leasing and admin placeholder | −10,000 |
| Net operating income before finance and tax | Calculation | 80,000 |
| DLD registration allocation | 4% of price, subject to the agreement | 80,000 one-off |
| Total acquisition cash used in denominator | AED 2,000,000 + AED 80,000 | 2,080,000 |
| Illustrative net yield | AED 80,000 ÷ AED 2,080,000 | 3.85% |
The AED 18 rate is an arithmetic example only, not an approved charge for any project. Replace every input with documentary evidence. At 20% vacancy, the same calculation gives AED 66,000 net operating income and a 3.17% illustrative yield. That is why a gross-rent headline is not an investment conclusion.
Worked VAT sensitivity at the same price
| Illustrative purchase | Property price | VAT treatment | Price plus VAT before other costs |
|---|---|---|---|
| --- | ---: | --- | ---: |
| Commercial | AED 2,000,000 | 5% = AED 100,000 | AED 2,100,000 |
| First supply of new residential building | AED 2,000,000 | 0% = AED 0, if conditions are met | AED 2,000,000 |
Commercial leases are also generally subject to 5% VAT. A VAT-registered tenant may be able to recover it subject to the normal rules; that does not mean the buyer can ignore invoice, registration and payment mechanics. Confirm treatment with a UAE tax adviser before exchanging contracts. Zero-rated is not the same as exempt.
Service charges: verify, never use a generic band
DLD defines service charges as RERA-approved annual amounts for managing, operating, maintaining and repairing jointly owned property. Its guidance includes items such as cleaning, security, utilities, administration, insurance, master-community charges and reserves.
Use the DLD Service Charge Index by project, usage and fiscal year. For a future project, obtain the developer’s written estimate and the eventual owners’ association or Mollak documents; an estimate is not an approved final charge.
- Confirm whether the quoted rate uses built-up, saleable, net internal or another chargeable area.
- Separate cooling, district-cooling capacity charges, fit-out maintenance and reserve contributions.
- Ask who pays service charges during void periods and whether the lease can recover them from the tenant.
- Recalculate net income with a higher charge, not only the sales estimate.
Vacancy and tenant risk: stress-test the lease, not the city average
DLD’s official Rental Index is residential. Its Smart Rental Index document says commercial and industrial indices are separate products; therefore, do not present a DLD residential rent benchmark as evidence for an office.
| Evidence to obtain | Why it changes the numbers |
|---|---|
| Three or more comparable signed commercial leases | Asking rents can hide rent-free periods, fit-out contributions and incentives |
| Current and upcoming competing supply in the same submarket | New choice can weaken renewal and reletting terms even when citywide occupancy is high |
| Tenant covenant, business licence and permitted use | A lease is only as durable as the occupier and lawful operation |
| Fit-out, approvals, reinstatement and brokerage budget | These create cash costs between tenants |
| Break, assignment, renewal and rent-review clauses | Headline rent may not be secured for the whole period you assume |
| Empty-period scenarios of 0, 6 and 12 months | Shows whether cash reserves can absorb a delayed reletting |
DLD’s investor guidance identifies Law No. 26 of 2007, as amended, as applying to residential, commercial and industrial landlord–tenant relations. Do not describe commercial leases as outside Dubai tenancy law; have the specific contract reviewed.
Buying from India under LRS
RBI permits resident individuals to remit up to USD 250,000 per financial year (April–March) for permitted current and capital transactions, including immovable property abroad under the applicable overseas-investment rules. The cap covers combined LRS use, not a separate property allowance. The scheme is for resident individuals, not companies, partnership firms, HUFs or trusts.
1. Confirm that the property, ownership structure and buyer are eligible with your authorised dealer bank and Indian adviser.
2. Obtain the complete payment schedule, including commercial VAT where applicable, DLD fees and other acquisition amounts.
3. Convert each instalment to INR at a planning exchange rate and leave room for currency movement; the USD limit is shared with other LRS remittances.
4. Complete the bank’s Form A2, LRS declaration, PAN and purpose-code process before each transfer.
5. Remit through the authorised dealer bank to the recipient account stated in the transaction documents. For off-plan, verify the project escrow details independently.
6. Retain SWIFT confirmations, bank advice, invoices, SPA, escrow receipts and Oqood evidence for your tax and audit file.
India’s collection at source is TCS under section 206C(1G), not TDS. Under the rules currently reflected in Ovation’s live guide, 20% applies above the ₹10 lakh annual LRS threshold, with Form 27D supplied by the collector. TCS can affect immediate cash flow even when credit is available through the tax return. Verify the rate for the remittance date with your bank and CA.
Read the full India LRS payment guide and compare the timing against off-plan payment plans. Deferred payments after possession need bank advice before selecting a post-handover payment plan.
Off-plan escrow, Oqood and ownership checks
DLD guidance says Law No. 8 of 2007 requires developers selling off-plan units to open a separate project escrow and deposit purchaser and construction-financing payments there. It also says disposals of off-plan units must be registered on the Interim Real Estate Register, commonly associated with Oqood, or be considered null and void. The guidance applies to real estate projects; it does not create a lighter commercial regime.
Before paying, record evidence for all six checks:
| Check | Acceptable evidence |
|---|---|
| Project and developer | DLD/RERA registration and current project status |
| Escrow | Account name, number and accredited escrow agent matching official records and SPA |
| Sale registration | Oqood/interim-register process, timeline and receipt |
| Ownership | Unit is within a designated foreign-ownership area and the tenure is stated |
| Delivery | Construction progress, expected completion and contractual long-stop/remedies |
| Commercial usability | Approved unit use, plans, parking, access and fit-out/licensing constraints |
Use the EOI checklist before any reservation deposit. Do not send funds to a broker’s personal account.
Ownership and visas: separate the decisions
DLD states that foreign nationals may own freehold interests, and usufruct or leases up to 99 years, in designated areas. That is an area-and-title question, not a blanket right attached to every commercial listing.
The UAE government describes a five-year renewable Golden Residence route for real-estate investors meeting its conditions, including property value of at least AED 2 million. The official portal also records conditions that may apply to mortgaged property and off-plan purchases. Buying any unit does not itself issue a visa; obtain written eligibility confirmation from the competent authority or an immigration adviser before treating residence as a benefit of the purchase.
A buyer’s decision rule
Commercial can fit when you can evidence occupier demand, understand VAT and fit-out cash flow, tolerate longer reletting and have reserves for a single-tenant void.
Residential can fit when the building has durable end-user demand, its approved charges leave acceptable net income and you want a potentially wider exit pool.
If the two options only differ by a brochure yield, the evidence is not yet sufficient. Start with the best areas for off-plan in Dubai for residential comparisons and use the Ovation project map to inspect available locations. Commercial availability must be verified project by project.

FAQs
Is Dubai commercial property better than residential for investment?
Not automatically. Commercial depends on business occupiers, permitted use, fit-out and reletting; residential depends on household and end-user demand. Compare signed comparable rents, service charges, vacancy and total acquisition costs for both. Neither category guarantees occupancy, rent or capital growth.
What net yield should I expect from Dubai commercial property?
There is no defensible universal yield. Calculate net yield from contracted rent minus vacancy, landlord-paid service charges and other owner costs, divided by total acquisition cost. Use comparable signed leases, not asking rents or a promised brochure return.
Is VAT charged on commercial property in Dubai?
UAE FTA guidance says commercial property sales and leases are generally subject to 5% VAT. The first supply of a residential building within three years of completion is zero-rated and subsequent residential supplies are generally exempt. Confirm the specific transaction with a UAE tax adviser.
Do off-plan commercial projects use escrow and Oqood?
DLD investor guidance applies project escrow requirements to developers selling off-plan units and requires off-plan disposals to be registered on the Interim Real Estate Register. Verify the project, escrow agent and Oqood process directly before payment; do not assume a receipt substitutes for registration.
How can an Indian resident pay for Dubai commercial property?
An eligible resident individual can remit under RBI’s Liberalised Remittance Scheme, subject to the combined USD 250,000 annual limit and applicable rules. Use an authorised dealer bank, complete Form A2 and LRS documentation, and budget for applicable TCS and VAT. Confirm the structure with your bank and CA.
How should I check service charges on a Dubai office?
Use DLD’s Service Charge Index with the project, usage and fiscal year, then reconcile the chargeable area and inclusions with official or Mollak documents. For an uncompleted project, a developer estimate is not the final approved charge.
Does buying Dubai commercial property qualify for a Golden Visa?
The UAE official portal provides a real-estate investor Golden Residence route subject to conditions, including at least AED 2 million property value. Eligibility is not automatic with any purchase; verify commercial, off-plan, ownership and financing conditions before relying on it.
